Expense Diary is made by BrightScale Labs Limited, a company registered in England and Wales (company number 16990009), registered office 8 Flay Field, Tithebarn, Exeter, EX1 3YA. Contact: contact@brightscalelabs.com.
These are the terms of the licence under which you use the Expense Diary software on your phone or tablet. They sit alongside the terms of service, which cover the app as a service and the subscription, and the privacy policy, which covers your data.
1. The licence
We give you a personal, non-exclusive, non-transferable licence to install and use the app on phones and tablets that you own or control, for your own records, under these terms. The app is licensed to you, not sold. The licence lasts as long as you keep the app installed and keep to these terms.
On iPhone and iPad the licence is also subject to the App Store's standard Licensed Application End User License Agreement and the usage rules in Apple's Media Services Terms; where that agreement gives you more than these terms do, it prevails. On Android the licence is also subject to the Google Play Terms of Service.
2. What you may do
- Use the app to keep a diary of your spending and income, and the accounts, bills, budgets and goals that go with it.
- Export your data as a backup, a PDF or a CSV, and take it anywhere, including to another product.
- Install the app on more than one of your own devices, subject to the stores' rules for your account.
3. What you may not do
- Copy the app, other than as your phone does to run it, or distribute, sell, rent, lend or sublicense it.
- Modify, decompile, disassemble or reverse engineer it, or try to extract its source code, except to the extent the law expressly allows despite this clause.
- Remove or obscure any copyright, trade mark or other notice in the app.
- Bypass or tamper with the advertising, the rewarded passes, the subscription check, the app lock, or the connection to the App Store or Google Play.
- Use the app to break the law, or use its name, icon or screens to suggest an endorsement or connection with us that does not exist.
4. Who owns what
The app, its code, design, text and artwork are ours or our licensors', and are protected by copyright and other intellectual property law. These terms do not transfer any of that to you. The entries, accounts, photos and reports you create with the app are yours, and we claim no rights in them.
The app includes open-source software under its own licences, listed in the app under Settings. Those licences apply to that software.
5. Third-party services
The free version shows advertising served by Google AdMob under Google's terms and privacy policy. The subscription is sold and managed by Apple or Google under their terms. iCloud backup, where you turn it on, is provided by Apple under Apple's terms, and a backup folder on another provider is governed by that provider's terms. Text is read from receipts and statements by Apple Vision or Google ML Kit on the device. Where the app opens another app or a website, what happens there is governed by that service's terms. We are not responsible for third-party services.
6. Updates
We may release updates that add, change or remove features, fix problems or meet the stores' requirements. An update is licensed under these terms unless it comes with its own. We are not obliged to keep supporting old versions of the app or of the operating systems it runs on.
7. Ending the licence
The licence ends if you delete the app, or if we end it because you have broken these terms in a way that is serious or that you do not put right when asked. When it ends, stop using the app and delete it. Your rights in your own data, and any backup you made, are unaffected.
8. Warranty and liability
The app is provided as it is and as available. We do not promise that it is free of mistakes or suited to a particular purpose. The limits and exclusions of liability in the terms of service apply to this licence too. Nothing here limits liability that the law does not allow to be limited, and if you use the app as a consumer your statutory rights are not affected.
9. Apple
For the version from the App Store: these terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to provide maintenance or support for it. If the app fails to conform to any warranty, you may tell Apple and Apple will refund the purchase price, if any; beyond that, Apple has no warranty obligation. We, not Apple, are responsible for addressing any claim relating to the app, including product liability, a failure to meet a legal or regulatory requirement, and consumer protection claims, and for the investigation and settlement of any claim that the app infringes a third party's intellectual property. You confirm that you are not in a country subject to a US Government embargo or designated as a terrorist-supporting country, and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Changes and law
If we change these terms we will update the date at the top and, for anything material, tell you in the app. These terms are governed by the law of England and Wales, with the same provision for consumers elsewhere in the United Kingdom and the European Union as in the terms of service. If any part is found unenforceable, the rest still applies.
